Florida Labor Law Updates 2025: What Every Employer Needs to Know

Minimum Wage Increases Take Effect September 30, 2025
Florida’s hourly minimum wage is currently $13.00 but will rise to $14.00 on September 30, 2025 — part of the scheduled climb to $15.00 by 2026.
All Florida employers must:

Update payroll systems before the September 30 effective date.

Post the new Florida Minimum Wage Poster in a visible location.

Ensure tipped and non-tipped employees are paid accurately.
Penalty alert: Intentional failure to pay the correct wage can result in fines of up to $1,000 per violation.
Tipped Employee Wage Changes
The tipped minimum wage rises to $10.98/hour in late 2025 (up from $9.98). Employers can still take a $3.02 tip credit, but only if wages + tips meet or exceed the state minimum.
Employers must also:

Provide written notice of any tip pooling policy.

Ensure managers and supervisors never share in pooled tips.
Poster & Recordkeeping Compliance
Florida law requires that all state and federal labor law posters—covering minimum wage, OSHA, EEOC, and unemployment insurance—be current and displayed for employees to view.
Federal law (FLSA) also mandates strict payroll recordkeeping, including:

Records must be kept for at least 3 years to ensure compliance with Department of Labor requirements.
Overtime & Break Requirements
While Florida follows federal overtime law, many employers still miss key details:

Overtime pay must be 1.5× the regular hourly rate.

Manual laborers must receive overtime after 10 hours in a single day.
Florida does not require meal or rest breaks except for minors. However, if employers do provide short breaks (< 20 minutes), they must be paid.
Workers’ Compensation & Unemployment Insurance
Florida employers must carry workers’ compensation insurance if they have:

Employers are also responsible for paying reemployment tax (Florida’s unemployment insurance) at an initial rate of 2.7% on the first $7,000 of each employee’s wages.

Florida employers must comply with both federal and state anti-discrimination laws. These prohibit workplace discrimination or harassment based on race, religion, sex, age, disability, and more. Employers must display an EEOC notice and ensure all staff have access to harassment and discrimination policies.
